The TTAB issued today its latest opinion (attached/linked to below) in Frito-Lay North America, Inc. v. Princeton Vaguard, LLC, the source of the two opinions in TLOSC considering whether “pretzel crisps” is a generic term.

In its 53-page opinion, the TTAB again found that “pretzel crisps” is generic and further found that the term lacked secondary meaning. In the next version of TLOSC, I will likely replace the two opinions in the casebook with an edited version of today’s opinion.
